Developers and Business People want to change your residential area

The owners of 16 Door de Kraal Avenue (corner De Bron) are applying for re-zoning to land use category 'Minor Business'.

Unlike the 'Consent Use' that applied to the crêche in De Bron Avenue, this re-zoning applies to the land not the occupant. In Consent Use, when the occupant changes the Consent Use falls away. With re-zoning, whoever owns the property, now and in the future, may legally operate a 'minor business' from there.

There is no clear definition of minor business in the planning document but the legal uses include shops and the right to build flats over the shops.

The issues to consider are:

  1. SECURITY - Premises unoccupied at night attract vagrants, provide avenues of escape for thieves and avenues of approach by thieves to neighbouring houses.
  2. TRAFFIC - Kenridge already has a traffic problem. Businesses bring traffic in the form of employees, customers and deliveries.
  3. DOMINO EFFECT - Business attracts business. Allow one to establish, precedent is set - and more follow. The neighbourhood changes forever.
  4. PROPERTY VALUES - Always an important consideration
  5. AMENITY VALUE - You probably chose to live here because it's a nice place to live. It may not stay that way.

If you like Kenridge the way it is - as a quiet, pleasant RESIDENTIAL SUBURB - you need to do something about this. You need to OBJECT. The more objections the council receive the less likely they are to allow the re-zoning.

Please see over for guidelines how to object. It's very simple.

Objections

There are two simultaneous applications, one for removal of restrictive conditions in the title deeds and one for re-zoning. This means you need to submit two objections.

One - Removal of Restrictive Conditions

Address a letter to the Director: Integrated Environmental Management, Dept. of Environmental Affairs & Development Planning either at Fax No. 021 483 3633 or to Private Bag X9086, Cape Town, 8000.

Objection In terms of Section 3 (6) of Removal of Restrictions Act, Act 84 of 1967

List your objections to removal of restrictive conditions that will allow for re-zoning to minor business, keep it short and sweet.

Quote your name and address and your own Erf number.

Sign it

Make sure it reaches the Director before 31 May 2010.
